Products” shall mean all items including services presently being sold by Bed Mecca Pty Ltd Online and In Store including but not limited to furniture, base, mattresses, duvets and pillows. 

In any event, these Terms and Conditions govern the supply of any product ordered by you on the website. By ordering a product, you agree to be legally bound by these Terms and Conditions. 

TERMS AND CONDITIONS OF SALE – ONLINE SHOP STORE 

Except as otherwise agreed in writing, all online purchases and transactions for the supply of the products by Bed Mecca Pty Ltd shall be subject to these standard terms and conditions of sale, 

including the Policies (collectively, the “Terms and Conditions”), as well as the Bed Mecca Website Terms and Conditions, 

 

On the Website, at checkout, once you click the "Pay" button a legally-binding agreement between you and the Company is formed. All orders with the Company will be sent to you via email.. 

The Customer shall be bound by these Terms and Conditions in all transactions relating to the purchase of the products using Bed Mecca online shop  

We reserve the right at all times to reasonably decline any order and/or to suspend delivery and/or to decline to supply the products to the Customer.  We further reserve the right to limit quantities and/or bulk purchases at our discretion. 

CHANGES TO THESE TERMS AND CONDITIONS 

We reserve the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates. 

We will use reasonable endeavours to maintain the availability of the Website, except during scheduled maintenance periods, and reserve the right to discontinue providing the Website or any part thereof with or without notice to you. 

The Company may in its sole discretion terminate, suspend and modify this Website, with or without notice to you. You agree that the Company will not be liable to you in the event that it chooses to suspend, modify or terminate this Website. 

 

PRICES 

The prices displayed on this site are quoted in South African Rands inclusive of Value Added Taxation (‘VAT’) and are valid only in South Africa. Prices do not include delivery charges. 

We have made every effort to display as accurately as possible all products and prices however, products and prices displayed on this site may vary from time to time and are subject to availability.

COLOURS 

We have done our best to display as accurately as possible the colours of the products shown on this website. However, the colours of our products shown on this website may look different on your computer compared with the colour of the actual product. This is because different computers / cell phones display colours differently depending on the type of computer screen (LCD, plasma, desktop, laptop etc.). We cannot guarantee that your monitor’s display of any colour will be accurate. 

Purchases and Stock Availability  

Although all product items are displayed on the website, this is no guarantee that there is stock available in the store or factory. Please feel free to call the store or factory to check availability. Bed Mecca Pty Ltd will not be held liable for products displayed on the website that are out of stock in the store or factory 

 

• In order to purchase products that are displayed on our website / online store, customers will be required to provide certain information, which may include personal information. 
• Prices displayed on our website are subject to change without notice.  

• All pricing advertised on our website includes VAT of 15%.  
• Orders placed may be declined or cancelled in the event of: 
• products being out of stock,  
• products being damaged or found not to be in suitable condition,  
• products that contain incorrect product information,  

• products that have incorrectly displayed prices,  
• payment for products not being received or  
• payments not being authorized by Bed Mecca  

 

. ACCURACY OF WEBSITE CONTENT 

All reasonable steps are taken to ensure that the information on our website is accurate and up-to-date. We do not, however, warrant that the content or information displayed is always accurate, complete and/or current. 

Errors:  We shall take all reasonable efforts to accurately indicate prices and delivery charges.  However, should products be erroneously offered at incorrect prices and/or delivery charges, We will not be obliged to sell products at such incorrect prices and/or delivery charges, but  shall  refund monies paid by you should you not wish to proceed with the purchase at the correct price and/or delivery charge. 

 

DELIVERY 

• No goods will be dispatched until payment has been settled in full. 

• Bed Mecca will contact the customer to arrange a date and approximate time for delivery. We require that the delivery document be signed by the customer once good have been delivered and inspected to indicate each item has been received in good order. Bed Mecca Pty Ltd cannot be held liable for any damages that aren't marked 
• Due to circumstances beyond our control there maybe instances where delivery times/estimates could be affected.  In these cases the customer will be alerted to any changes. 
• Deliveries will only be made where there is reasonable access.  It is the customer's responsibility to ensure that items can easily pass through doors, staircases etc. and that old furniture and breakables are removed from the space where the goods are to be delivered.  No furniture will be hoisted up balconies or through windows.  If the customer requests these terms to be ignored, Bed Mecca will not be held liable for any damage to goods or property. 

• Additional deliveries due to customers missing delivery appointments and/or inaccessible premises may be payable by the customer.

• Goods not delivered due to factors beyond Bed Mecca’s control could attract additional charges. 

• Delivery Charges 
• Prices advertised on this website excludes delivery charges unless stated otherwise – the delivery fee will be displayed during the ordering checkout process, but before checkout has been finalized.  
• Deliveries to outlying areas such as farms, small towns or high risk areas may be subject to additional charges. 

Delivery Time Frames 

• Depending on the size of the order and the exact delivery location, our standard delivery period is approximately 3-10 days from the date of payment.   

Longer delivery periods may be applicable for orders placed during or leading up to the festive season (15 November to 15 January),  

Deliveries will be done on weekdays during the courier/transporter’s standard daytime service hours. 

• After hour deliveries may be subject to surcharges.  
• Deliveries to outlying areas such as farms, small towns or high risk areas may take longer due to lower volumes and less frequent availability of vehicles 

Delivery Process 

• In the event where goods have been shipped out via third party delivery service providers, and a reasonable number of delivery arrangements and/or attempts are proven to be unsuccessful due to customers not responding or cooperating, goods will be returned back to our warehouse and customer may be held liable for the return costs incurred. 
• Upon delivery or collection of an Order, a delivery/collection note will be issued for signature, confirming the Items that are being delivered or collected, delivery fees, VAT and the amount paid. 
• The customer should always check that the Items being collected or delivered are correct and are free from any defects. Should the packaging be damaged, and the customer accepts the Order without fully inspecting the Items, the customer is required to document on the delivery note stipulating that the packaging was damaged, or items were not inspected. 

Where there is an issue with the Items detected after acceptance of the Order, the customer should notify us via email on bedmecca2@gmail.com without delay in order for us to be aware of any issues with the Items, and in order for arrangements to be made for the items to be returned  

Although reasonable care shall be taken, we cannot accept responsibility for incorrect delivery details that have been provided to us, or if an unauthorized person at the chosen delivery address accepts delivery of an order, as we do not verify the identity of the person at the delivery address who signs the delivery note 

Delivery shall be made strictly on a ‘door-to-door’ basis. Delivery shall not include installation of products, removing products from packaging, clearing areas, rearranging furniture, hoisting products over balconies or through windows, removing and refitting railings or doors or other barriers, discarding packaging or any other special service required by the customer. 

Manufacturer’s Warranty 

The manufacturer’s warranty will only apply to defects in the process of manufacturing the goods and will not apply in the following instances: 

• Damage caused by misuse or abuse to the goods. 
• Goods used for a purpose other than the purpose for which they were manufactured and intended. 

• Accidental damage; and 
• Damage caused by the customer in any attempt to repair the goods 

Defective or Faulty Goods under Guarantee 

Defective or faulty goods are items that have a latent material imperfection in the manufacture of a product or any characteristic of a product, which makes the product less acceptable than one would reasonably be entitled to expect in the circumstances. 

Goods that are found to be defective or faulty, still fall within the original guarantee period, and satisfy all the conditions of this policy will be repaired or replaced at no charge to the customer.  

Should the product be out of guarantee, the product will be returned for assessment. If the product can be repaired, Bed Mecca will provide a quote for the necessary repairs. Repairs will not be undertaken without prior consent of the customer, who is then responsible for the payment of the necessary repairs as per the quoted amount. 

The following will NOT be regarded as patent or latent defects and will not entitle a customer to a return under this section for repair at no cost: 

Damage arising from wear and tear 

Damage arising from negligence, user abuse or incorrect usage of the product 

Damage arising from a failure to adequately care for the product 

Damage arising from unauthorized alterations to the product. 

We reserve the right to either repair or exchange an item submitted for guarantee purposes. In the event where the item cannot be repaired, it may be exchanged with a replacement item that is identical, or where the exact same model or product is no longer available, with an item of similar value.
